How to appeal against a decision

Once the application has been processed, the enterprise will receive the decision letter in its mailbox in Altinn. The decision letter will state whether the enterprise has been awarded a grant and, if so, how much. If the enterprise is not awarded a grant, the decision letter will state why the application was rejected. You have the right to appeal against any decision you receive.

Who can appeal?

The applicant has the right to appeal.

What can you appeal against?

You should appeal if you believe we have calculated the grant itself incorrectly based on the figures you submitted, or alternatively if you believe we have based our calculation on other facts which are incorrect, or if you believe we have made a procedural error.

Deadline for receipt of appeals

Appeals must be submitted within three – 3 – weeks, starting from the date on which you become aware of the decision; see Section 29 of the Public Administration Act.  In other words, from the date on which  you receivethe decision letter in Altinn.

Appeals submitted more than three weeks after the deadline will normally be rejected. However, in certain special cases, we may consider an appeal even if it is received after the deadline.

Under no circumstances can appeals be considered if they are received more than one year after the decision was made.

What information must be provided in the appeal?

Appeals must provide the following information:

  • The decision you are appealing against
    State the case number and the grant number shown in the top right of the decision letter.
  • Why you are appealing against the decision
    Explain why you are appealing. You should include any information and documentation which you believe could be of importance to an assessment of the appeal.
  • The changes you are requesting

Who should the appeal be sent to?

The Norwegian Ministry of Trade, Industry and Fisheries is the appeals body, however all complaints should be sent to The Brønnøysund Register Centre. Either by regular post to: Brønnøysundregistrene, Kompensasjonsordningen for Næringslivet, 8910 Brønnøysund or via e-mail firmapost@brreg.no.

The Brønnøysund Register Centre will consider the appeal first. If we conclude that the appeal cannot be upheld, we will refer it to the Ministry of Trade, Industry and Fisheries for a final decision.

Where can I find the rules concerning the appeal procedure?

The processing of appeals is regulated by Chapter 6 of the Public Administration Act.
